Limitation of Consulting Relationship
Use of this Website, submission of forms, emails, consultations, discovery calls or other communications with Fenix Consulting LLC does not establish a formal client-consultant relationship unless both parties execute a signed engagement agreement.

No Guarantee of Results
Fenix Consulting LLC does not guarantee specific business, financial, operational, profitability, cash flow, cost savings or performance outcomes.
Results vary based on many factors, including client participation, implementation, data accuracy, market conditions, operational execution, business environment and other external factors beyond the Consultant’s control.
Client Responsibilities
Clients are solely responsible for business decisions, implementation of recommendations, and verification of financial, operational, and business information provided to the Consultant.
The Client is responsible for providing accurate, complete, and timely information necessary for consulting services. Fenix Consulting LLC is not responsible for errors, delays or outcomes resulting from incomplete, inaccurate, outdated or misleading information provided by the Client or third parties.
Limitation on Financial Reliance
Clients should consult their own tax, legal, accounting, investment, or financial professionals before making significant business, tax, legal, investment or financial decisions.
Information and recommendations provided by Fenix Consulting LLC should not be relied upon as a substitute for licensed professional advice specific to the Client’s situation.
Independent Contractor Relationship
Fenix Consulting LLC acts solely as an independent contractor and advisor and does not assume fiduciary responsibility unless explicitly agreed in writing.
Nothing contained within the Service or any consulting engagement shall be construed as creating a partnership, joint venture, employer-employee relationship, agency relationship or fiduciary relationship.
Confidentiality and Data Security
Fenix Consulting LLC takes reasonable measures to protect confidential client information and data shared during consulting engagements.
However, no electronic transmission, cloud storage system, email communication, software platform, or data storage method can be guaranteed completely secure. By using the Service or sharing information electronically, You acknowledge and accept these inherent risks.
Clients are responsible for ensuring they have the proper rights, permissions, and authority to share any financial, operational, employee, customer, vendor or business data with Fenix Consulting LLC.
Intellectual Property
All content, materials, templates, frameworks, dashboards, reports, methodologies, graphics, financial models, process maps, workflows, documentation, training materials, and intellectual property provided through the Service remain the exclusive property of Fenix Consulting LLC unless otherwise agreed in writing.

Client-specific deliverables may be used by the Client for internal business purposes only, unless otherwise agreed in a signed engagement agreement.

The Company assumes no responsibility for the content, privacy policies, security, accuracy, availability or practices of any third-party websites or services.

Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its service providers under any provision of these Terms, and Your exclusive remedy for all claims, shall be limited to the amount actually paid by You through the Service or 100 USD if You have not purchased anything through the Service.
